Teenage girl in court for false charge

A 16-year-old girl appeared in the Kimberley Magistrate’s Court on Monday for defeating the ends of justice after she falsely claimed to have been sexually assaulted.


The girl had claimed that she was sexually assaulted by her stepfather two years ago, when she was 14, but later confessed that she had lied.

The girl, who cannot be named because of her age, will appear again in court tomorrow.

According to police spokesperson Const Sergio Kock, she had earlier claimed that her stepfather had touched her and fondled her private parts. Her mother, who was married to the man, died in 2000.

The girl claimed her stepfather lured her to his home in Florianville, Kimberley, on June 17, 2009, by telling her she should come to try on clothes he had bought her.

After the alleged sexual assault, the man was arrested the same day and spent 22 days in prison before being granted bail in July 2009, said Kock. “After attending court for more than 2 years, the girl confessed to the state prosecutor that she lied about the sexual assault. The charges were later withdrawn.”

The girl told the state prosecutor that her aunt, who passed away in 2009, had told her to fabricate the allegations against the man.

Kock said the aunt took the girl to the health clinic where tests were conducted on the girl.

Head of Kimberley detectives Col Avril Wentzel warned that action would be taken against anyone who laid false charges of any sort with the police. Police had expertly trained officials and would do thorough investigations to ensure that the charges laid were factual. “Police will ensure that justice is served without bias,” Wentzel said. Action would also be taken against adults who encouraged children to lay false charges.
